Verisign is owner of U.S. Patent Nos. 8,880,686 and 9,342,698 and EP Patent No. EP 2 611 116 (collectively, the "Patents") relating to the subject matter of Internet Draft ["draft-ietf-dnsop-rfc7816bis"] ["draft-ietf-dnsop-qname-minimisation"] and any successive versions deriving therefrom (collectively, the "I-D"). Standards Development Grant. ------------------------------------------------------ Accordingly, Verisign grants to any party, during the pendency of the foregoing I-D, a world-wide, non-exclusive, no-charge license under said Patents to make, use and import products and/or services that implement such I-D for the purposes of facilitating the standardization of such I-D. Grant on Standardization. ------------------------------------------------------ In the event the technology in such I-D is included in a standard (Proposed Standard or Internet Standard) adopted by the IETF such that one or more claims of said Patents would necessarily be infringed due to requirements for practicing the normative portion(s) of such standard (each an "Essential Claim"), Verisign hereby revokes the Standards Development Grant above and grants to any party a perpetual, world-wide, non-exclusive, no-charge, irrevocable (except as provided below) license under the Essential Claim(s) to make, use, sell, offer for sale and import products and/or services that implement the standard; provided, (A) any such party making, using, selling, offering for sale, and/or importing such products or services, shall include therein, or shall ensure that such has been included therein, an attribution notice as set forth below, and further provided, (B) Verisign retains the right to: (i) terminate the above license and assert its patents (including Essential Claims) against any party that institutes or agrees to institute patent litigation (including cross-claims or counterclaims in a lawsuit), either directly or indirectly, against Verisign or any of its affiliates, (ii) assert its patents (including Essential Claims) relating to any products or services that are not fully compliant with the subject standard, and (iii) exclusive of the Essential Claims, assert its other patents and claims with respect to any products, services, or portions thereof, not required for compliance with the standard.
