This is to advise the IETF, in accordance with the IETF RFCs 3979 and 4879 that Nokia Technologies Oy believes that patent (EP2375749), and its associated patent family members, (together “the Disclosed Patents”) may be required to implement the following IETF contribution” draft-ietf-payload-vp9-10” (the “Contribution”).

To the extent that the Contribution is incorporated in an IETF RFC, Nokia Technologies informs IETF that Nokia Technologies and its Affiliates are prepared to grant a license on fair, reasonable and non-discriminatory (“FRAND”) terms and conditions, subject to reciprocity from those seeking a licence, to implement such IETF RFC for those claims of the Disclosed Patent(s) only that would, in the absence of a license, be necessarily infringed by the making (or having made), using, selling, importing, or otherwise disposing of a technology fully implementing such IETF RFC. In this context, “necessarily infringed” means that infringement of such claims is technically necessary to implement such IETF RFC.

“Affiliate” of Nokia Technologies means any legal entity that directly or indirectly controls, is controlled by or is under common control with Nokia Technologies. Control in this context, exists where one entity owns more than fifty percent (50%) of the voting stock or equity in another entity, or regardless of stock or equity ownership, is otherwise able to direct its affairs or to appoint a majority of the members of the board of directors or an equivalent body to determine the course of action of the entity by virtue of its voting or other rights. Such entities shall only be deemed to be Affiliates, hereunder for as long as such control exists.
