VIII. Other Notes

Previous (#4098) This (#4334)

Per Ninth Circuit ruling in Case Number 14-17574, from USDC SF 14-CV-03629/WHA "any and all uses of US6370629 and US6393126 per the settlements carry with them a California Law req. which permeates any data moving thru protocols using them too.

All unreleased uses carry with them the mandatory open-source lic. Rule that California and ONLY California law is applied to any use of the IP in any form without release. This ALSO means any data moving through any IETF protocol stack or other system which uses these methods is tied to those licensing terms unless it gains a release from the settlement terms. Those are available for end-users and IETF protocol stack implementors at FRAND rates for Developers and flat fees for EULA users.
