Acklio undertakes to permit any party to use the subject matter of Declared Patents as defined below under reasonable, non-discriminatory terms as defined below, with reciprocity, to implement and fully comply with Derived Standards as defined below.

The reasonable non-discriminatory terms are:

Acklio will not assert Patent EP3541040A1 or any Patent declaring Priority (“Declared Patents”) therefrom against any party for making, using, selling, importing or offering for sale a product that implements a standard adopted by the IETF implementing technology described in this document to the extent that the described technology falls within the scope of one or more Declared Patents (“Derived Standards”), provided, however that Acklio retains the right to assert patents, including Declared Patents, (including the right to claim past royalties) against any party that asserts a patent it owns or controls (either directly or indirectly) against Acklio or any of Acklio’s affiliates or successors in title or against any products of Acklio or any products of any of Acklio affiliates either alone or in combination with other products; and Acklio retains the right to assert patents including Declared Patents, against any product, portion, thereof that is not necessary for compliance with Derived Standards.

Royalty-bearing licenses will be available to anyone who prefers that option.
