If the technology in this document is included in a standard adopted by the IETF, any entity will have the right to use any claims of any Skype patents that are necessary for practicing the technology to the extent that the technology is included in the standard, under royalty free, reasonable and non discriminatory terms, to implement and fully comply with the standard. These terms shall include: Skype retains the right to terminate any license grants and assert its patents (including the right to claim past royalties) against any entity (including its affiliates) that asserts a patent owned or controlled by it or its affiliates (either directly or indirectly) or that brings any lawsuit against Skype or any of Skype’s affiliates or successors in title; Skype retains the right to assert its patents against any product or portion thereof that is not necessary to comply with the standard; and the entity will agree not to assert any patents that are necessarily infringed by practicing the technology against any other entity practicing the technology, or against Skype or its licensees. A royalty-bearing option will also be available.
