Apple Inc. ("Apple") is the owner of one or more pending patent applications referred to herein (“Subject Patents”) that include one or more claims that Apple believes may be essential for implementing technology set forth in the Internet-Draft entitled “Happy Eyeballs Version 2: Better Connectivity Using Concurrency” dated September 10, 2017 (draft ietf-v6ops-rfc6555bis-05). If technology in this Internet-Draft is included in a standard adopted by the IETF (the “Standard") and any claims of the Subject Patents are necessary for practicing the Standard, any party will have the right to use any such patent claims ("Subject Claims") under reasonable, non-discriminatory terms, with reciprocity, to implement and fully comply with the Standard. The reasonable, non-discriminatory terms are: If the Standard is adopted by the IETF, Apple will not assert the Subject Claims against any party for making, using, selling, importing or offering for sale a product that implements and fully complies with the Standard, provided, however, that Apple retains the right to assert the Subject Claims (including the right to claim past royalties) against any party that asserts a patent it owns or controls (either directly or indirectly) against Apple or any of Apple’s affiliates or successors in title; and Apple retains the right to assert the Subject Claims against any product or portion thereof that is not necessary for compliance with the Standard. |
