Other info | Based on a ruling from the US Appellate Court on Thursday of this week my petition to strike as unenforceable the Settlement Agreement was affirmed meaning the Settlement Contract is NOW FULLY VETTED BY THE APPELLATE COURT FOR ENFORCEMENT. That means any protocols which contained methods of US6370629 as well as the LBS and Digital Certificate based protocol standards all require mandatory compliance with the Settlement Terms meaning the IETF AND ITS MEMBERS ARE BOUND BY THIS DOCUMENT http://www.slideshare.net/tglassey/contractsddisettlement AND ITS SECTION 8.1 TERMS. That means ALL of the IETF and ITU Standards this effects including those used in creating the code inside the routers, switches and computers (both Client and Server) are tied to this same requirement now. That everyone using them agree that the data touched by the execution of that code is tied to the Laws of the State of California and any Contracts using that Data are likewise tied to the Laws of the State of California. For the record we formally moved numerous times to have the Settlement set aside, and first the State and then the US District court blocked and then the Appellate Court affirmed that blocking the Setting Aside of the Settlement by its dismissal. So now that Contract is pretty much cast in Concrete and its time for everyone to come into conformance with it or purchase the FRAND Release from the CALIFORNIA LAW LICENSING CLAUSE WHICH FUNCTIONALLY IS THE KEY OPEN-SOURCE TERM FOR THE USE OF THIS IP. //Todd |
