VI. Licensing Declaration

The Patent Holder states that its position with respect to licensing any patent claims contained in the patent(s) or patent application(s) disclosed above that would necessarily be infringed by implementation of the technology required by the relevant IETF specification ("Necessary Patent Claims"), for the purpose of implementing such specification, is as follows(select one licensing declaration option only):

Possible licensing choices a), b), and c) when Licensing Declaration to be Provided Later:
  • a) No License Required for Implementers
  • b) Royalty-Free, Reasonable and Non-Discriminatory License to All Implementers
  • c) Reasonable and Non-Discriminatory License to All Implementers with Possible Royalty/Fee
Previous (#2469) This (#2542)
Licensing Declaration to be Provided Later (implies a willingness to commit to the provisions of a), b), or c) above) Licensing Royalty-Free, Reasonable and Non-Discriminatory License to All Implementers

Due to the early state of both the patent application and the internet-draft, coverage of the claims versus the I-D text is difficult to ascertain, a licensing declaration to be provided later if required.

Verisign is owner of US Patent No. 8,880,686 (and any foreign counterparts thereto) relating to the subject matter of Internet Draft "draft-ietf-dnsop-qname-minimisation-00" and any successive versions deriving therefrom (collectively, the “I-D”).

In furtherance of IETF standardization, it is Verisign's business practice to make licenses to its patents available on reasonable and nondiscriminatory terms and conditions.

Standards Development Grant.
------------------------------------------------------
Accordingly, Verisign grants to any party, during the pendency of the foregoing I-D, a world-wide, non-exclusive, no-charge license under said patent to make, use and import products and/or services that implement such I-D for the purposes of facilitating the standardization of such I-D.

Grant on Standardization.
------------------------------------------------------
In the event the technology in such I-D is included in a standard adopted by the IETF such that one or more claims of said patent would necessarily be infringed due to requirements for practicing the normative portion(s) of such standard (each an “Essential Claim”), Verisign hereby grants to any party a perpetual, world-wide, non-exclusive, no-charge, irrevocable (except as provided below) license under the Essential Claim(s) to make, use, sell, offer for sale and import products and/or services that implement the standard;

provided, (A) any party creating such products or services shall include therein an attribution notice as set forth below, and

further provided, (B) Verisign retains the right to:

(i) terminate the above license and assert its patents (including Essential Claims) against any party that institutes or agrees to institute patent litigation (including cross-claims or counterclaims in a lawsuit), either directly or indirectly, against Verisign or any of its affiliates,

(ii) assert its patents (including Essential Claims) relating to any products or services that are not fully compliant with the subject standard, and

(iii) exclusive of the Essential Claims, assert its other patents and claims with respect to any products, services, or portions thereof, not required for compliance with the standard.
